General Terms and Conditions

For the webshop star-biker.com — valid for all orders from consumers residing in the EU, especially Germany.

§ 1
Scope and Exclusion of Commercial Buyers
(1)

This offer is exclusively directed at consumers within the meaning of § 13 BGB (German Civil Code). Entrepreneurs are not entitled to order.

(2)

These General Terms and Conditions apply exclusively. Deviating conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

§ 2
Conclusion of Contract and Agreement on Quality
(1)

The product representations on our website are non-binding and do not constitute a legally binding offer. A contract is only concluded upon our written order confirmation via email or by dispatch of the goods.

(2)

Minor Defects: Production-related, minimal optical impairments — for example, fine scratches on the underside of frames, weld seams, or in the area of the chassis — which do not affect the technical function, safety, or the overall aesthetic appearance under normal use, are considered contractual quality. Such characteristics do not constitute a material defect.

Note: Photos on the website serve for product illustration. Color deviations due to display settings do not constitute a defect.

§ 3
Prices, Shipping Costs and Transfer of Risk
(1)

All prices include the statutory value-added tax. Shipping costs are explicitly stated in the order process and are not included in the product price.

(2)

Deliveries within the EU (especially Germany): The seller bears the transport risk until the goods are handed over to the customer or a person designated by them. In case of transport damage, the damage must be reported immediately to the delivery service and to us.

(3)

Special feature for Swiss customers: For customers residing in Switzerland, the benefits and risks, in accordance with Art. 185 OR, transfer to the customer upon delivery of the goods to the forwarder or carrier. Transport damage must be asserted by the customer directly against the carrier.

§ 4
Right of Withdrawal for EU Consumers
(1)

Consumers in the EU have a statutory 14-day right of withdrawal according to § 312g BGB. In Switzerland, there is no statutory right of withdrawal for online purchases; we voluntarily grant a right of return there under the conditions published on our website.

(2)

Return Costs: The customer bears the direct costs of the return. For bulky vehicles that must be returned by freight forwarder, the costs are expected to be EUR 150.00 to EUR 250.00 per vehicle.

(3)

Compensation for Value upon Use: For testing the nature and functionality, a test drive of a maximum of 2 km on private property is permitted. In case of use beyond this, the customer owes compensation for the depreciation incurred, according to § 357 Abs. 7 BGB.

(4)

Exclusion of Right of Withdrawal / Compensation for Value upon Registration: The right of withdrawal expires or leads to an obligation to compensate for value of at least 20% of the purchase price as soon as the vehicle has been officially registered or provided with an insurance plate. With registration, the status as new goods is irrevocably lost.

(5)

Withdrawal Form: To exercise your right of withdrawal, you can use the statutory model withdrawal form in accordance with Annex 2 to Art. 246a § 1 (2) sentence 1 no. 1 EGBGB. The form is not mandatory — a clear statement (e.g., via email to info@star-biker.com) is sufficient. The complete withdrawal policy can be found at /pages/widerrufsbelehrung.

Important: Do not register or license the vehicle until you are sure you want to keep it. Already completed registration leads to high compensation for value.

§ 5
Warranty and Bring-In Obligation
(1)

The statutory warranty period of 2 years from delivery applies in accordance with §§ 434 ff. BGB.

(2)

Central Service Location (Bring-In): The place of performance for all subsequent performance services is our central service point in North Rhine-Westphalia (Germany). On-site repairs at the customer's location are excluded.

(3)

Transport Obligation in Case of Complaint: The vehicle must be delivered to the service point at the customer's cost and risk. For EU customers, transport costs will be reimbursed if a justified defect exists. For Swiss customers, the customer bears the transport costs in full.

§ 6
Voluntary Star-Biker Guarantee and Maintenance Obligation
(1)

We grant a 24-month voluntary warranty on the frame and engine — beyond the statutory warranty.

(2)

Self-assembly and Safety Check: Our vehicles are delivered partially assembled. Final assembly (especially front wheel, handlebars) is carried out by the customer according to the enclosed instructions and the assembly tutorials on our website. The customer is obliged to have the vehicle checked for assembly errors by a qualified specialist workshop before initial commissioning. The warranty exceeding the statutory minimum period expires if this safety check cannot be proven by an invoice. Damages caused by faulty self-assembly are excluded from liability.

(3)

Maintenance Intervals: A prerequisite for warranty claims is the complete observance of maintenance intervals — especially the initial inspection after 500 km or 6 months. Without written proof, the warranty claim expires.

(4)

Exclusions: Damages due to software manipulation (tuning), deep discharge of the battery due to lack of care, and improper use are excluded from warranty and liability.

(5)

Relationship to Statutory Warranty: The voluntary Star-Biker guarantee exists alongside the statutory warranty rights and does not restrict them in any way. Your statutory rights to subsequent performance, withdrawal, and reduction according to §§ 434 ff. BGB remain unaffected and can be asserted independently of the warranty conditions.

§ 7
Liability and Software Integrity
(1)

We are liable without limitation for intent or gross negligence, as well as for injury to life, body or health in accordance with legal provisions.

(2)

In case of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, typical damage for the contract.

(3)

Software Manipulation: Any alteration of the vehicle software (tuning, removal of throttle, manipulation of control units) leads to the immediate expiration of the operating permit and to a complete exclusion of liability for all resulting damages.

§ 8
Choice of Law, Jurisdiction and Dispute Resolution
(1)

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For EU consumers, the mandatory provisions of the country of residence — in particular German consumer law — remain unaffected.

(2)

The place of jurisdiction for Swiss customers is CH-5210 Windisch. For consumers in Germany, the general statutory place of jurisdiction applies.

(3)

Online Dispute Resolution (ODR): The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. According to § 36 VSBG, we are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

§ 9
Payment and Default in Payment
(1)

The purchase price is due upon completion of the order. Available payment methods (including credit card, PayPal, Klarna installment purchase, purchase on account) are shown in the ordering process.

(2)

For installment payments via Klarna or comparable providers, the General Terms and Conditions of the respective payment service provider also apply. We are not a party to this credit relationship.

(3)

If the customer is in default of payment, we are entitled to demand default interest at a rate of 5 percentage points above the respective base interest rate in accordance with § 288 (1) BGB. The right to claim higher damages caused by default remains reserved.

(4)

We reserve the right to cancel the order and offer the vehicle elsewhere if payment is not made on time. In this case, any payments already made will be refunded immediately.

§ 10
Retention of Title
(1)

The delivered goods remain our property until full payment of the purchase price, including all ancillary costs (retention of title in accordance with § 449 BGB).

(2)

In the event of default in payment, we are entitled to reclaim the goods subject to retention of title. The return does not constitute a withdrawal from the contract, unless we expressly declare this in writing.

(3)

The customer is not entitled to pledge, assign as security, or resell the goods subject to retention of title without our consent as long as the purchase price has not been paid in full.

§ 11
Delivery, Delay in Delivery and Non-Availability
(1)

Delivery is made by freight forwarder to the delivery address specified by the customer within Germany and the EU. Delivery times are specified on the product page and in the order process and are non-binding guidelines, unless a binding delivery date has been agreed.

(2)

If we are in default of delivery, the customer may withdraw from the contract after a reasonable grace period has expired. Claims for damages are governed by the liability provisions in § 7 of these General Terms and Conditions.

(3)

Non-availability: Should an ordered vehicle not be available despite proper coverage, we reserve the right to inform the customer immediately and withdraw from the contract. Payments already made will be refunded immediately and in full. No further claims by the customer exist, unless we are responsible for the non-availability.

(4)

Partial deliveries are permissible if they are reasonable for the customer and do not incur additional costs.

§ 12
Data Protection
(1)

The collection, processing, and use of personal data are carried out exclusively within the framework of applicable data protection laws, in particular the GDPR and the BDSG. For details, please refer to our privacy policy at /pages/datenschutzerklaerung.

(2)

For the processing of payments and installment purchases, your data will be passed on to the respective payment service providers (e.g., Klarna, PayPal, Stripe), insofar as this is necessary for the fulfillment of the contract.

(3)

For the purpose of processing the delivery, the necessary data will be forwarded to the contracted freight forwarder.
