Terms and Conditions (T&Cs) for the star-biker.com webshop

These T&Cs govern the contractual relationships between Star-Biker® – Official Store, Schwimmbadstr. 2, 5210 Windisch, Switzerland (hereinafter "Seller") and consumers (hereinafter "Customer") for all orders placed via star-biker.com.
§ 1 Scope and exclusion of commercial buyers
(1) This offer is exclusively directed at consumers. Entrepreneurs within the meaning of the law are not entitled to order. (2) These T&Cs apply exclusively. Deviating conditions of the customer are not recognized.
§ 2 Conclusion of contract and quality agreement
(1) The product representations are non-binding. A contract is only concluded upon our written order confirmation or delivery. (2) Minor defects: Production-related, minimal optical impairments (e.g., fine scratches on the underside of frames, welds, or in the area of the chassis) that do not affect the technical function, safety, or overall aesthetic appearance under normal use are considered to be in conformity with the contract. Such features do not constitute a material defect.
§ 3 Prices, customs duties and transfer of risk
(1) Prices include VAT. Shipping costs are explicitly stated. (2) For deliveries within the EU (especially Germany), the seller bears the transport risk until handover. (3) Special feature Switzerland: For customers residing in Switzerland, the benefits and risks pass to the customer upon handover of the goods to the forwarder or carrier, in accordance with Art. 185 OR. Transport damage must be claimed directly by the customer from the carrier.
§ 4 Right of withdrawal for EU consumers (barriers & compensation for value)
(1) Consumers in the EU have a 14-day right of withdrawal. In Switzerland, there is no statutory right of withdrawal. (2) Return costs: The customer bears the direct costs of return. For bulky vehicles that require freight forwarding, the costs are expected to be between EUR 150.00 and EUR 250.00 per vehicle. (3) Strict compensation for value: For testing the functionality, a test drive of max. 2 km on private property is permitted. For use beyond this, the customer owes compensation for the loss in value. (4) Exclusion due to registration: The right of withdrawal expires or leads to a massive obligation to compensate for value of at least 20% of the purchase price as soon as the vehicle has been officially registered or fitted with an insurance license plate, as this irrevocably loses its new condition.
§ 5 Warranty and "bring-in" obligation
(1) The statutory warranty period of 2 years applies. (2) Central service location: The place of performance for all supplementary performance services is our central service point in NRW (Germany). On-site repairs at the customer's premises are excluded. (3) Transport obligation: In the event of a complaint, the vehicle must be delivered to the service point at the customer's risk. For Swiss customers, the customer bears the transport costs. For EU customers, costs will be reimbursed if a justified defect exists.
§ 6 Voluntary Star-Biker Guarantee and Maintenance Obligation
(1) We provide a 24-month warranty on the frame and motor. (2) Self-assembly & safety check: Our vehicles are delivered partially assembled. Final assembly (especially front wheel, handlebars, pedals) is carried out by the customer according to the instructions. The customer is obliged to have the vehicle inspected for assembly errors by a qualified specialist workshop before initial commissioning. Any warranty extending beyond the statutory minimum period expires if this safety check cannot be proven by an invoice. Damages due to faulty self-assembly are excluded from liability. (3) Strict maintenance hurdle: A prerequisite for warranty claims is also strict adherence to maintenance intervals (first inspection after 500 km or 6 months). Without written proof, the claim expires immediately. (4) Exclusions: Damages caused by software manipulation (tuning) or deep discharge of the battery due to insufficient care are strictly excluded from liability and warranty.
§ 7 Liability and Software Integrity
(1) We are liable without limitation for intent or gross negligence. (2) Any modification of the vehicle software leads to the expiration of the operating license and to the complete exclusion of liability for resulting damages.
§ 8 Choice of Law and Jurisdiction
(1) Swiss law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For EU consumers, the mandatory provisions of their country of residence remain unaffected. (2) The place of jurisdiction for Swiss customers is CH-5210 Windisch.
